Pre-Foreclosure in Virginia: What to Do After Missing Payments
By Virginia Cash Real Estate ·
Facing foreclosure in Hampton Roads? Start with our full avoid foreclosure guide — sell before the auction for the big-picture timeline and every option on the table.
Pre-foreclosure is the stretch between your first missed mortgage payment and the day a trustee's sale is actually scheduled. It's the quietest part of the process and the one with the most options. Most Hampton Roads homeowners we talk to waited until a sale notice arrived before calling anyone. By then, a lot of good choices have already closed.
This guide covers what's happening behind the scenes during pre-foreclosure in Virginia and what you can do each month to stay ahead of it.
What Pre-Foreclosure Means in Virginia
Virginia is a non-judicial foreclosure state. Your lender doesn't need to file a lawsuit. Instead, the deed of trust you signed at closing names a trustee who can sell the house once you default and the required notices go out. That makes the process fast, so the early months matter.
"Pre-foreclosure" isn't a legal term. It's simply the period when you're behind but the trustee hasn't set a sale date.
The federal 120-day rule
Under federal mortgage servicing rules, most servicers can't make the first official foreclosure filing until you're more than 120 days delinquent. That gives you roughly four months of breathing room after the first missed payment. It isn't a grace period. Late fees and interest keep piling up the whole time.
What you'll receive in the mail
- Late notices after each missed payment
- Early intervention letters describing loss mitigation options, usually around day 45
- A notice of default / breach letter giving you a deadline to catch up, usually 30 days
- A notice of trustee's sale. Virginia law requires it to reach you at least 14 days before the sale. Once it arrives, you're no longer in pre-foreclosure.
For what happens after that notice, see our Virginia foreclosure timeline, day by day.

Five Things to Do During Pre-Foreclosure
1. Open every letter and write down the dates
It sounds obvious, but avoidance is the most common mistake we see. Put every deadline on one calendar. The dates on those letters decide which options are still available to you.
2. Call your servicer and ask about loss mitigation
Ask what they offer: repayment plans, forbearance, loan modification. If you send a complete loss mitigation application more than 37 days before a scheduled sale, federal rules generally bar the servicer from moving ahead with the sale while they review it. Our guide to talking to banks about foreclosure covers what to say on that call.
3. Figure out whether you still have equity
Get a realistic sense of what the house would sell for as-is and subtract your loan balance, back payments and fees. If there's equity left, selling before the sale date protects it. If you owe more than the house is worth, your path looks different. A short sale vs. cash sale comparison helps you weigh it.
4. Decide honestly whether keeping the house is realistic
A loan modification only helps if the new payment fits your income for the long haul. We break down that decision in loan modification vs. selling your house.
5. Talk to a HUD-approved housing counselor
They're free and they work for you, not the bank. You can find one through HUD's website or by calling 800-569-4287.
Why Selling During Pre-Foreclosure Is Usually Better Than Waiting
If keeping the home isn't realistic, the earlier you sell, the better:
- More time means a better price. You aren't forced to take whatever comes in the last week.
- Less in fees. Each month adds late charges, attorney and trustee costs, and interest that comes out of your equity.
- Cleaner credit. A sale that pays off the loan reports as paid, not as a foreclosure.
- You choose the move-out date instead of facing an eviction timeline.
How a Cash Sale Works in Pre-Foreclosure
We buy Hampton Roads houses as-is. You don't need repairs, cleaning or showings. The title company orders a payoff from your lender, including any arrears and fees, and pays it at closing. Whatever is left goes to you. We can usually close in a couple of weeks, or later if you need more time to line up your next place.
